I got the same RFE and my 140 was pending at that time. In my denial letter, uscis officer mentioned lot of employees with their WAC numbers mentioned that they haven't got properly paid for each quarter. The letter completely talks about my ex-employer and if your company has many people on bench, even though you are in good shape with your W-2's and current contracts, it may cause problem for your H1-B petition. It don't say that my ex-employer had violated lot of rules on purpose, USCIS happened to be very strict about implementing every rule from 2007. I have contacted sheela murthy firm at that time and they have suggested me to file AC21 after 140 gets approved(luckily approved), file H1-B and another labor , another 140 just in case if USCIS goes after approved 140's because of fraud or any other reason and denies them. I do not have any idea about the impact of H1-B denial on I-485 and i seriously doubt it coz 485 is completely our application. However 140 may cause issues. Please find out about that from a good attorney and please keep us posted. Let me know if you need more information on this matter..
AC-21 can not be availed if I-140 is revoked by USCIS due to fraud.

FYI...
yes now the rules have changed after April 5 2010. but the furstation is Lufthansa continues to maintain and say you do not need a ATV....if you have AP...which means they will let you on a Plan from India.
I am intrested to know from any one who has travelled after April 5 2010 who can share how their documents were checked in Germany after the arrival. I am sure they have no issue to let a person board a US bound Plan as that person is leaving Germany any way and has no issues when he arrives in USA as CBP offercers knows what AP is....

The aug bulletin come into effect Aug 1 2008.
If the visa numbers are available they may issue GCs instead of EADs for the applications they process now and that already been submitted during the Jul 2007 fiasco. Its not like they have to wait until Aug 1st to start approvals of GC.

I am all for sending the flowers.
We should send 50-100 all at once, perhaps timed and have the local or national media cover it. I can assure you that this will be a fantastic news for them to carry because it is very unusual.
But, there must be story and logic we can explain to the media. Can anyone come up with a "story" that can make sense.

Programmers Guild fears lame duck Congress will pass the Skil Bill

Programmers Guild president Kim Berry sent out an alert to his minions today asking them to contact their elected representatives not to vote for the Skil [Securing Knowledge, Innovation and Leadership], Senate Bill 2691 and its counterpart in the House H.R. 5744, sponsored by Republican John Cornyn in the Senate and Rep. John Shadegg [R-AZ] in the House.
"The Cornyn-Shadegg SKIL Bill is a Trojan horse with a risk of being attached to an unopposable omnibus appropriations bill in the
lame duck session" of Congress, Berry said in his alert.
The bill would raise the cap on H-1B visas from 65,000 to 115,000 annually and would create a more flexible system that adjusts to so-called market demand. It also exempts foreign nationals who have earned a Master's or higher degree in an accredited U.S. university from the H-1B visa cap.
Opponents of the bill say that both Democrats and Republicans will more than likely pass the bill as they seek the support of companies who seek to increase the overall labor pool of skilled workers.
While both the House and Senate bills are sponsored by Republicans, Berry said that most Democrats have supported H-1B in the past, and one can only assume they will again.
"I'm not aware of any Democrat who ran for the House that opposes Bill 5744," said Berry.
Norman Matloff, a professor of computer science at the University of California at Davis called the bill an "unwarranted expansion of both the H-1B and employment-based green card programs."
Matloff refutes the claims of a high tech labor shortage.
"The impact of this bill on U.S. citizens and permanent residents in the tech field will be quite harmful," Matloff said, claiming salaries adjusted for inflation have been flat in high tech since 1999.
Berry proposes increasing the H-1B visa fee to $5,000 per year to subsidize the education of U.S. engineering students.

I will attend the rally and the lobby day with my wife and two daughters.
Question to proponents of business suits - my younger daughter is 6 months old; what should she wear as a business suit? The elder one is 3� years and she doesn't have one!
Let this not be a fancy dress competition. Why are we talking about the dress code right now in the first place? Is that the only decision left to be made?
Shantanup, We are NOT making this a fancy dress competition. Are you really going to argue about making your 2 kids wear business suits now? Or are we just trying to be difficult? The point here is that we want to clearly distinguish ourselves from the "Undocumented/Illegal" immigrants. One "CLEAR AND DISTINCT" way to do this is to dress in Business Suits, thereby sending the message to the lawmakers that:
"We are well educated, smart and intelligent people who can contribute to the economy **AND** we have waited in line the CORRECT WAY. So Please stop putting people who have broken the law ahead of us".
We are NOT dressing is suits to be "FANCY". I cant believe what I am reading on here, when you ask "should I dress my kids in suits too"? Let me ask you some counter questions to that one:
1) Are your kids facing the same problems you are, when it comes to immigration-related policies?
2) At their tender age, can they be counted as "Highly-Skilled Legal Immigrants?
3) Are the kids even "immigrants" or are they citizens of the US?
4) ...... (the list goes on).

hmmm... sorry my bad. I did not made it clear to understand. When I said amended return, I meant didn't have to pay tax. I did all these process using help of a CPA. He showed my (TDS) account, but since the tax was already deducted by bank (my parents send me bank's letter) I did not have to again pay tax on that.
However, I did have to pay tax in case of account with no TDS.
hope it is clear now.

Usually the tax is higher in India for TDS than US 1040, so one gets extra credit, since foreign tax paid is higher.

I have a thought, right now the housing industry is slowing down, The new home sales have dropped signinficantly last month.
We all know that Indians and Chinese are very good savers and have significant amount of their salary saved. Normally Indians and Chinese do not commit to buy a home when their GC is in process. They wait for a GC to be approved and buy a house only after they get their GC.
SO CAN WE TAP INTO THE LOBBYISTS FROM THE HOUSING INDUSTRY??
My thesis is one of the MAIN reasons in the new homes slow down is that people are waiting either at labor stage in BEC or in stage 3 for priority date for GC to be approved to buy houses.
We are talking about well educated well paid immigrants who have a very good discipline of saving and will definitely become home owners if GC is approved faster.
SO CAN WE CONVINCE THE HOUSING INDUSTRY LOBBYISTS TO FUND OUR LOBBYING OR USE THEIR RESOURCES FOR OUR JUST CAUSES??
