If you go through the H1b case data for the year 2005, (which can be downloaded from flcdatacenter), and look for the job code 030 (computer jobs),
and sort their salaries, you will see programmer analysts and software engineers being paid 25000 anually, Yes they are in california and other costly cities.
There are many programmer/sw engg jobs well belo 45000 annually.
This is what drives NumbersUSA and Programmers Guild to cry out "H1B fraud" and "Cheap Labor Imported". And they have facts to support them. This issue is serious and increasing H1b numbers without Reforming H1b for fraud and cheap labor is indeed a disaster for not only american citizens, but also to future aspirants of GC and Citizenship. In fact we should support NumbersUSA and ProgrammersGuild if they are proposing this reform.

I too feel that USCIS can not assign a visa to an application in wait until August 1st 2008. But again we are taking about USCIS and anything is possible. Even if it starts on August 1st, please do not keep your hopes high as August 1st is a Friday, and USCIS officers will take it easy on that day. I guess, the real action will start from Monday August 3rd.
However, what if we realize that not many approvals are coming through after August 3rd. I was wondering if we shall brainstorm on such scenario, and decide what should be our course of action in such case?

If you want to narrow the difference of PD between EB3 and EB2 then many EB3 persons eligible for EB2 need to convert to EB2. If you want EB3 and EB2 PD to become current then recapture bill or any EB reform bill need to be passed in congress. There is no easy way out.
Nobody is even talking about EB3-I. How can we get some help from IV on this matter? We must do something.

My Hr got the cover letter showing my labor approved by email from dallas BPC. My lawyer does not seem to have received the whole package yet(no idea why lawyer don;t get the packages on time). I have no clue.
But my HR asked Dallas BPC officer and she said that cover letter was enough to file for I140and plus I485(concurrent)
The cover letter is part of the whole approval package.

i got the following email from my congressman (i have highlighted the items that i think seemed interesting to me)
You no doubt have heard about the Stimulus Package agreement between Speaker Pelosi, Minority Leader Boehner and Treasury Secretary Paulson that was announced today and is supported by the President. I won't go through all the specifics of it directly because you will hear and see that almost everywhere over the next 24 hours. But I would like to give you what I see as the pros and cons of the thing. First of all, the good stuff:
Raises FHA loan limits to $750,000 and also raises the "conforming" or "jumbo" home limits on loans guaranteed by Fannie Mae and Freddie Mack to the higher of $625,000 or 150% of the median house price in a market. This will help to free up more and cheaper home loan money in high cost areas like Orange County. This should help ease the housing crisis.
Gives some taxpayers with adjusted gross incomes of less than $75,000 (single) or $150,000 (joint) some of their tax money from 2007 back.
As far as I can tell, that's it on the good side.
On the bad side, here goes:
Gives roughly 35 million people who paid NO FEDERAL INCOME TAXES AT ALL a check for $300 per person in their family. So, a married couple with 3 kids would get $1500. This is a welfare transfer payment from other taxpayers, pure and simple.
Gives taxpayers with incomes over $75,000 (single) and $150,000 (joint) zero, zippo, nada. These are the people who pay most of the taxes and they will now pay a much greater share of the tax than they already do.
We don't yet know what, if any, mechanisms will be in place to keep illegal aliens from receiving these checks. If you file a tax return with no tax due and you have 4 kids, you will get a non-taxable $1800 check. The incentive for fraud will be huge.
The checks will likely not get to people before July or August, when the economic downturn is projected to be over. So, it will not provide any stimulus right now.
The FHA and Fannie and Freddie loan limit increases are not accompanied by any additional regulation. The reason these loans are cheap is because you (the taxpayers) effectively guarantee them. If taxpayers are going to guarantee them, but someone else (the shareholders of Fannie and Freddie) get the profit, then the taxpayers ought to make sure that those entities are being careful with the money. This has not been the case in the recent past. Although I have supported the higher loan limits, I have only done so on the condition that we would have better oversight of these agency�s actions than we do now.
There is absolutely nothing in this proposal that encourages what we need most, which is to free up investment capital for loans and equities. This economic slowdown was caused by a credit and capital crisis. Not a consumer spending crisis. We should be trying to free up credit and capital. We are treating our arm when it's the leg that hurts. For 3 years our deficit has been declining. With this bill the deficit will balloon again to somewhere over $300 billion. This is approaching what it got to after 9/11. It is not good to increase deficits. But more than that, I fear that this increased deficit will make it politically more difficult to do the tax policy changes we SHOULD do in the near future, like extend the 2001 and 2003 tax cuts, fix or eliminate the AMT and reduce or eliminate the death tax. And you can be sure that the very people who received tax benefit from this package will be asked to "pay for" the cost of this thing next year or the year after.
Neither the Democratic nor Republican leadership in the Senate has signed off on this package yet, so it could still change. But the White House and the House leadership are certainly trying to "grease the wheels" to run this through quickly and with as little change as possible.
I hate to oppose something that does give some taxpayers back some of their money and which contains some elements that will should help the housing crisis. But, I also don't want to support something that has so many negative aspects for the longer term as a trade-off for so little benefit.

If this memo is true, in nutshell, the memo de-recognizes 'AOS' status and expects I-485 petitioners to maintain some other status like H, B, L etc. This is a complete 'U turn' of USCIS policies and tries to add one more hurdle in the lives of people waiting in line for years.

Our Pd is Oct 2005 - EB2 - NSC Center - July filer
Our EAD got renewed and AP is still pending.
One Doubt i have is there was a LUD on 7/27/2008 on our last year AP, this is been approved long back what does this mean?. However no LUD on 485.

This happened even in 1998. My colleague at Tata infotech (Bangalore) was sent back immediately because of the unsatisfactory answer to "What is the purpose of your visit?" She was on B1 visa and answered something like programming.
Seems like some of the stories are bit over the top and I truly hope that they are just rumors and not real incidents.
She should have told "Training and Transfer of knowledge". People on B1 cannot use the word "work" nor use any term that correlates to "work".

I also in same boat with 3 year diploma + 3 year BE with EB2 I-140 pending @NSC. I am also expecting RFE on this.
Did you submit any evaluations for RFE OR just letters from your college/polytechnic?
Did you submit letters from both polytechnic and BE college?
Is it possible to send some sample of those letters?
Please help me on this.

Answer to original poster: Your 3 year B.Tech is absolutely eligible for EB2, provided if you have at least studied 4 years in accredited college/polytechnic to receive your terminal B.Tech degree, after 12 years of high school diploma. There is a difference between combination of education and pattern of education. Your�s falls into different pattern of education. So, you are fine. I am one of the classic example successfully got 140 approval from NSC in EB2 after a RFE. Mine also 3 year B.Tech. Do not spend money on education equivalency evaluation. USCIS do not care even if you submit 10 evaluations from different companies, they do not recognize. Fist, edu.evaluation is opinion only. It is not a binding document. Gets a letter from your school explaining the education pattern. It is more efficient. I did the same. They approve my 140 on the same date they reciived my reply.
The entire education equivalency has been screwed up by desi companies, desi workers, education evaluation agency and of course lawyers. USCIS had been very flexible till last 5 or 6 years. Because of substantial abuse, the USCIS had become stricter on the education evaluation. Peoples try to combine any degree (like 3 year b.com and 1 year PG diploma) to arrive at equivalent to 4 year BS in computer science. I have seen a post by one guy got a evaluation saying that his 3 year BSc in geography + 1 year computer course in NIIT/Aptech equal to 4 year BS in Comp.Sc. USCIS is not stupid to accept this is equivalent to 4 years computer science. I am not undermining any degree or school. Because of so much abuse, genuine guys like you and me I got affected. Though I studied in highly reputed schools, I got RFE in 140. It was a big surprise for me. It took tremendous amount of time/money/energy to overcome the RFE, though I graduated from one of the top 10 engineering school in India comparable standard with IITs.
Do not worry.. It will be alright..
