Hi friends,
I am from south east Michigan just like everyone else here standing in the never ending line of gruesome and crippled immigration system.
Let us come together and help IV achieve our goals.
It is high time, that we ask for what we deserve. And it wont come unless we stand up for ourselves.
thanks....

I did not feel like signing along for two reasons: we are not US citizen yet, and I consider myself citizen of the world and will always be. I do not aspire to become citizen of the United States of America.
Even when Americans sang their national anthem in a church, I felt not right. Churches are not supposed to be linked to states. There should be no country boundary within the Christian world.
There should be no country boundary within the world we want to build either.
By the way, if the United States go to war with your country of birth, who will you side with? Will the United States trust you?
Newsflash: USA is a country (with a boundary). USA has a national anthem. They like to sing it, everywhere. If it makes them happy when I sing it, I will sing it too. It is like visiting someone's home and you are asked to take off your shoes at the entrance. Maybe you don't agree with it, but out of respect to the host it is a nice thing to do.
Relax and be more generous! I think you have more boundaries in you than this country has.
(If USA goes to war with my home country, I think they will trust me less if I come here and live and refuse to sing the national anthem...)

Hello All ,
My application for i485 , i765 and i131 was recvd in Lincoln,Nebraska on July 23 , 2007. (Sent by my company's attorney on July 21) . I have been waiting for over 2 months for any updates or receipt notice but nothing so far . After reading some forums in this website , i called USCIS (number from USCIS website) and got my case escalated to an officer who asked my last name ,first name , date of birth and coutry of birth . He gave me all the three receipt numbers for AOS , AP and EAD . All the receipts numbers are starting with WAC meaning the cases were xferred from Nebraska to California Service Center . When i looked at online status of i485 case , it says the case is xferred to Nebraska since it is in their jurisdiction . The other two cases for EAD and AP are pending . I still have not recvd any receipt notices from my attorney . So , i guess everyone who is waiting for their receipt notices might want to call USCIS and get their numbers .

I had my GC approved out of line last year in aug [was current (pd march 2006), but processing time wasn't current for texas at that time]. EADs for both me and my spouse had been approved like 1 week before this happened. Hers was for 2 yrs and mine for 1 yr. What happens to her application if I loose my job or leave my job ? I am the primary.
Since that I-485 is a derivative application, your job change should not impact her pending I-485 application.

Can we see a list of all the positive outcomes of the various advocacy events, lobbying etc done by IV for the EB immigrant community please?
And, if any of those good outcomes are being implemented by USCIS to ease the EB backlogs?

Beautiful friday and these scumbag news! If he sues you, counter-sue him for unnecessary duress.
First things, he will never sue you...it costs him more than what he can ever get from you so dont bother
Regarding your pay: if you did not get paid for the time you worked, do you still have the timesheets you submitted at client-site? If you have them prepare a complaint with DOL, attach the timesheets and clearly mention what has been going on since you completed work and any emails or phone bills showing calls between you and employer. Clearly mention your employer threatened to sue you if you pursue opportunities outside his company.
Filing a complaint is easy, cheap and risk-free - do not be afraid - and do not be rude - just do it
Let the scumbags pay for their crimes...

I have some good news and some bad news!
The bad news is that. You will get your green card in 5 years and after other five years you will get your citizenship. So in 10 years will be in position to get married.
Now , you will be wondering what is the good news.
Well!, I just saved a bunch of money on my car insurance by switiching to GEICO.:D
Funny..

My son and you are in the same boat. He came here 9 years ago went to middle/high school here. Now, he is in college and will turn 21. He will not get his greencard because he is here on H4 legally.
Isn't that a shame?
andy
Q1: Is H4 only valid for children under 21. What happens to children who have been here for long on H4 status and turn 21?
Q2: If the answer to the first part of Q1 is YES, will the approved I140 (that included the dependent H4) be valid?

Exactly, you have to be mature enough to be able to handle the responsibility. There isn't a set age for this. I know adults who still aren't mature enough.

What is your idea/plan to do with this Data ? My Eb3 140 is pending since May 2007 at NSC. What are they up to - why the dates are NOT moving beyond Mar 2007 ? Who can ask this questions to NSC , we don't have the authority to do that.
I found 1 point to drive this - there are lots of peoples who got EB3 140 approved after my Receipt Date May 2007. If we can compile that data in spread sheet and share that with our Local Congressman/Senator just to show them how NSC is mis managed that might create some pressure - what do you folks say ?
Thanks!
Hi Guys,
This is a small list I have compiled. Can we all share our RECEIPT #'s, CATEGORY and PD's & COUNTRY as well, so we have another method to gauge how NSC is/not processing our files. I will update the list with your postings. Thanks!

As an Indian minister, I will speak up for fair treatment of Indians anywhere. - Kamal Nath - Union Commerce Minister, India.
http://www.outlookindia.com/full.asp?fodname=20060306&fname=Mittal&sid=2
They will not care for us at all! But, there is an outside chance that one of the retrogressed is related to one of them or somebody knows a politician... and our e-mail also reaches them at the perfect time! And, one of the concerned politician/minister happens to meet one-on-one with Karl Rove, or any such powerful figure in the Bush Team! And, they bring it up with the Bush Team, who assure them they will make Retrogression disappear!!!
;) Hey, if we were so lucky - one of us might have won $365 mil Powerball, and donated $200K or more to IV outright! I would have, I know that for sure!
But, we have to keep trying every which way! Everything to gain- nothing ventured, nothing gained! Please, do not misunderstand me - I am not making light of somebody's ideas! Great things happen only if we keep trying!!!

First of all let me congratulate and thank IV for working tirelessly to bring about this huge benefit for most folks stuck in the green card mess. I have always believed in IV and its power to move mountains. However, in the midst of all this rejoicing, let's not forget a certain class of IV members who will not be able to take advantage of this recent benefit for all practical purposes. I am talking about the folks who are currently single and will not be able to file for their (future) spouse before Aug 17. It seems to me that the best thing that IV can do to bring relief to these folks is to lobby for and effect legislation to exclude dependents from the visa cap, i.e let dependents (or at least spouse) to file for I-485 even when priority dates are not current. I believe this single piece of legislation (if we can make that happen) will have a big effect on the entire community, because that will free up that many visa numbers that would otherwise have been used up, and let folks get their GCs faster (even if they are happy with their EADs and APs). Can IV focus on this front please ?
Congratulations btw to everyone who will be taking advantage of this window of opportunity.

When I applied last year I got it for 9 months and for 1 yr when I applied in 2009, eventhough my priority date is not current. I called them on 90th day after my application was filed and that has triggered something and I got my EAD in a week. I assume they have plenty of work load and in order to clear EAD applications they are just approving with out any emphasis on priority dates and with whatever duration they like.
This erratic EAD approval process causes financial loss to all EAD applicants effected.

I'm in a similar situation:
EB2 LC Priority Date: August 25, 06
I-140 pending
Received I-1485 receipt notice and EAD
I-485 Reciept Date: August 1st, 07
I want to do an internal move from the position of "Software Engineer, Test Automation" to "Software Engineer, Webapp Developer". The job duties are similar but not exactly the same. Also, the job qualifications for the first job required BS + 5 (which I don't have yet) or MS (which I have). My company specifically made it this way for me. But the job qualifications for the new job is just BS + 3 (this is apparently not EB2). But now they are not willing to change the job qualifications for the new job to be EB2 since they have to do recruiting/advertisement reports, etc. for the new position.
My lawyer says its illegal to change job duties w/o notifying USCIS. They say I cannot do that even with an approved EAD. Is this true? If so, is there any USCIS documentation backing this.
Thank you for all the great work you guys do.

Hi Kunal,
I am in the same boat. In my online status it showed exactly same msg. Then after couple of days it started showing the following msg:
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: This case has been sent to our local office for processing.
On May 19, 2008, we transferred this case to our DES MOINES, IA location for additional processing. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done. This case has been sent to our DES MOINES, IA location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
Please note: All this status changes and Soft LUD's are only for primary applicant and not for spouse's application. we have no connection with DES MOINES, IA, never stayed there , never worked there nor our company is from there. Don't know why it got transfered to local office there.
I am hoping that this all means that my case is assigned to officer.
Guru's any idea what all this means?
Just saw a soft LUD today. No status change from yesterday though.
fundo14 - how long has it been since it was transfered to the Des Moines office? Have you called and spoken to an IO about this change?
