I would advise to keep the announcement secret till as long as possible. It should be posted only when it is tabled in Senate or House or where ever. Several agencies are working against our interests and we should not caution them.

Your lawyers delayed by a week or month, but a famous lawyer in San Francisco - Jackson hertogs, never did the paper work on time for me, leading to considerable loss in my GC processing. I had to wait for 4 more years before I could file my GC, since my company stopped processing from 2001 aug till 2004. Cannot be worse that this, during 2000/2001 the lawyer would mention everything is on track. I was hoping everything would be fine, finally I heard my papers along with some other employee never got filed.
Whenever I think of it, my blood boils with frustration, we are at the mercy of lawyers, employers and feel like born to be abused :-). I would like to hang in for a little while, my company has a big presence in Blr, so plan to move there as there are great job opportunities to grow to good Management positions. If I delay this on account of this GC Mirage, I will end up burning a candle from both ends and loose both eventually.

We dont know USCIS will accept 485 appls between July 2nd filer and july 16th filer.
As per notice on 17th July - They will start from this date to accept application....BUT NOT CLEAR !!! - maybe we are getting this some info related between July 2nd and July 16th filer

I agree with you Shukla. Complaining people should understand that IV coremembers common people like everybody like us. They dont have any powerful contacts or back channels to Capitoll Hill or wherever political decisions are ironed out. The difference between Coremembers and complaining members are that, Core Members are sacrificing a lot personal time and money on behalf of all of us who are in this shit.

80k does not kicks in when he gets GC...the condition is:
1.Company "should have" the capacity to pay 80k when he gets GC, this is through tax-returns etc.
2.OR he should be paid 80k when he Labor is filed.
In his case, item 2 is the one which works but USCIS is coming after Item 1 and that becomes difficult task because how can you pay 80K when you don't have enough profit etc..
how can even you question company when the applicant has already ported under AC21 and switched employers. From that time, the new employer is responsible for paying proffered wages and thats what document they ask for when issuing AC21 RFE.

What you said is true but do remember USCIS can visit any case any time and I-140 can be revoked due to fraud,mis-representation etc and they can take these issues for fighting with you. Read unitednations inputs in this forum.
You have strong case if you are ready to fight but until you get all the documents from your original GC company you may have difficult time to prove it.

Thanks for your efforts and time. Contacting all the people over here and collecting data from each memeber and putting it together. it is not an easy task. I really apprceitate your efforts !!
when i contacted my congressmen's aide she said there were many cases this fall with this problem in San Diego itself... But when i started compiling list hardly there were 40 all over USA. I am not sure why many of us are worried that if we speak out our cases are in jeopardy... Unless we come out of this mis perception its not easy to succeed... Many people who have reported when it came to providing receipt numbers, names didnt even bother to reply me back... I didnt mind but that doesnt solve the problem. Only when IV reported they did take this as a action item... we can use these type of notes in future as proof of problem... and will help all.

Total different sets of information.IV core team has right to question USCIS about validity of FOIA data for which IV paid $5000 (I believe..).As Pappu mentioned USCIS has confirmed earlier saying FOIA data is correct.But now inview of USCIS publicly announced data ,IV again now ask USCIS about the correctness of FOIA data received from USCIS.In case USCIS again confirms FOIA data is correct.Then we can assume either USCIS is cheating public by publishing a false data on their web site or we may be wrong interpreting & analyzing the data.Definitely something wrong.Any one agree with me.Any other thoughts??

-Not sure what you mean by "To go to India, we do not need a transit visa". My understanding is that you need Transit visa every time via the German Airport.
-As per the Consualte website you need to appear in person. You cannot apply via post.
-I am travelling to another state to get apply for my visa. (to Illinois).
-I asked the consulate if I both my onward and return journey will be covered by one transit visa. He replied in the mail saying they will try to cover me bothways.
-Since you have only one week I am not sure if you could get back your visa within that time frame. The embassy says it will take 2 weeks to send back the stamped passports.
my suggestion is that to send an email to the embassy right away explaining your situation (lack of time) and ask their advice.

We are discussing pros & cons of returning back to one's home country & one of the factors to be considered is upward career mobility which can get restricted in the US due to our skin color.
Wrong again with respect to Hispanics because they are considered part of diversity. But not w.r.t to "reserve jobs" Affirmative action in US, unlike India, does not require reservations at all. You are laboring under some totally wrong beliefs about affirmative action in the US --- possibly because of your exposure to the Indian system.

Totally agree. We need to focus on the bills that have the maximum likelihood of getting through. The country caps are evil - they should face the least resistance and must be first to go.
What is the response from Lofgren's office on this one? Anybody?

I'm an immigration analyst, and I can tell you at this time the republicans are wary of any bill- repeat any bill- that increases immigration. I know we are taking about a recapture bill, and a STEM exemption bill, but the end result is still more imigration. Precisely for that reason, Rep Bob Goodlatte, an influential Virginia republican congressman in the house republican leadership, has refused to sponsor HR 5882 and HR 6039 (he even said as much during a recent interview). He has sponsored the hard country cap removal bill with Rep LOfgren though. THis bill does not involve any visa recapture/temporary increase in immigration, but just tweaking of the parameters within the existing framework, CHC is also opposed to any visa relief for skilled workers, and this bill will enounter the least resistance from the CHC and republicans.
Even if the hard country caps are removed, EB3 IND will see dates move forward signficanly. THen, you will not be penalized from being India.
Guys what do you think. How can we push this one forward- just have 5 or so weeks in this session. IV core, ??
