My DL was renewed for four years, much beyond my I-94 expiry, both the times...so guys, come on to CA...Golden land of jobs, good weather, cosmopolitan and accomdating/tolerant ppl of all races/religions :-). I am still on H1-B though..

NIW is tricky. As you have PhD, you can apply yourself (w/o sponser) in EB1 Researcher catagory, if you do that kind of job.
The only self-sponsoring category are: EB2-NIW and EB1-EA (Extra Ordinary). EB1-EA is harder but EB2-NIW is not easy either. NIW will have to argue why labor certification should be waived. Talk to a lawyer. You will have to show YOUR work not just the field you work in has merit and in national interest. And you bring unique abilities to the US. Your past achievements and not future potential counts more.

I came back via Frankfurt last month. AP no prob. But be aware of Lufthansa. It was worst trip of my life. Bugger airline had cancelled flight from FRA to Mumbai without notifying. They gave me two options after I landed at FRA. 1. Wait at airport for 27 HOURS for next days flight (as they don't give Indians visa @ airport for hotel stay) or 2. Wait for another 6 hours at airport, then take flight from FRA to zurich, wait at zurich for 3 hrs, then zurich to Dubai, wait at dubai for 3 hrs and then dubai to Mumbai. Unwillingly I had to accept 2nd option.
Staff is damn rude, had to wait in long line for 3 hours to talk to cust service.

I have two 797s: one which is current valid till June 2007 and the other from July '07 till July '10 (using my approved I140). I am going for visa stamping this March at Chennai consulate. Can they combine both my 797s and stamp me till 2010 or they'll do it only till June 2007?

I am not sure when the CIR will pass...its not on Nancy Pelosi aganda in forseeable future... and several people already mentioned that if it didnt pass by MAY07 then you are looking at Jan 09 to get immigration stuff to happen...
I think we need to work on an interm EB relief bill ...which is absolutely non contraversial and try to pass it....not worring about piggy backing the CIR...
Issues such as h1 increase or adding more numbers need not be in it...we can include things like EAD after I-140...spouse/childer not considered for EB quota...etc...
Unless we act desissively now...its going to be a long way to 2009..

May be we can take it like this, depending upon the volume of the approvals, the dates will go back, higher the approvals, lesser the retrogression.

I don't know if CSC is still processing 485 EB applications but CSC EB processing cut off date on its website is April 04, 2006. The priority date for June 2007 bulletin was April 1st2004.
Lot of big law firms filed 485's around August 1st because the date for filing 485's was extended to August 17th. So I think these 485's are still unadjudicated. Once they get adjudicated there would be retrogression. Analysts analyze. However the silver lining would be removal of concurrent processing of I-140 and I-485 which may give some additional EB 2 numbers next year.

I like your optimistic attitude but unfortunately I don�t share it because of past and current behavior of USCIS, like for instance how they willfully disregarded the 180 day name check memo. Do you really believe them when they say name check will be cleared in 2009, just like the current name check memo the fbi name check clearance will be thrown in a dustbin. If by a miracle name check is solved they will come up with some other check delay for example IBIS name check delay. the bottom line is if there is a will there will be a way, USCIS has no will what so ever to help us. Good luck to everyone but just build a reservoir of patience because if you have hope on USCIS you will pay dearly.

Can you please help me with this?...I have already submitted the affidavit copy and now they want it from Registrar office. Has any one got it from registrar office in India? if so, how difficult it is and what is the procedure?

A photocopy of a birth certificate issued by the Additional District Registrar’s office if the person named above was born in a village.
If a birth certificate does not list the names of both mother and father, or the child, secondary evidence must be submitted to establish parentage. Secondary evidence includes, but is not limited to , copies of: medical records, school records, census records, government-issues identity cards, religious records and/or affidavits from at least TWO persons alive at the time of birth. The oldest available evidence that lists the names of both parents should be submitted."

I have been there. done that. As soon as ported labor applicant using AC21 moves on & finally gets his GC, his labor cannot be ported anymore; even though you filed to use his labor before he obtained his/her GC.
Mind you, I used labor substitute not from a shady consulting company but from a reputed nasdaq listed company & had top lawyers appealing and proving my case. No use.
I think AC21 & labor substitution fundamentally had these issues where they could not co-exist. Since labor substitution was prone to abuse anyway. It was done away with. Good riddance to bad rubbish I say. Just I had to spend 3 years in limbo. What can I say - only solace is that there are others who are worse of than me.
Move on. Theres no point appealing this denial of I140.
