WE can also get the transit visa from India right?. My family is travelling next week and I am not in a US State which has a german consulate, which means I have to send it by post.
To go to India, we do not need a transit visa, so I am thinking of applying it in India for the travel back to US.
Also, when we get the transit visa do they give for the entire duration between begin and end dates (if visa applied from US), or they give two visas for specific begin and end dates.

Guys , when i called up today for I-485 petitions for USCIS i was little bit worried when first officer informed me of the process and she explained why we are not receiving receipt numbers.
But after 20 min long discussion with her i was little worried and thus want to share this info for your comments.
As per her" USCIS will wait for all 485 petitions , and assign them visa numbers as per availability , she told me that they exhausted all visa numbers on june 26 2007. and they are going to receive all unused numbers on aug 17 and will assign accordingly for all cases who are considered for adjudication.
If they run out of visa numbers again during this process they will return applications saying apply after October 2007.
After going though i couldnt believe myself and i called them back to enquire about the same. another officer told me the same that this is the update they have. If this is the case is USCIS really accepting or playing with us ? i dont understand at all. Out of curiocity again i asked my friend and he reported same info. I dont want to rise panic flag with this info but just share and request your comments. please.

sure. I agree completely. I am on my 2nd year right now and applied for LC. I am not sure what will be outcome of this bill. what do you thin the best bet for me ???

I guess you should be ok since you have another 4 years left on h1. By Oct 2008, you can easily port to the new system, if that is what comes out of this bill when it becomes the law. Keep the LC application going. you may never know.

Got approval/document sent email May 19th.

my notice date is 27th, still online shows as Intial review, no sms (didnt have email alert setup)
is it okay to travel after you get the email/status change but before having the docs in hand. i dont want to take a chance but if anyone has done that please share you experience.

No doubt the industry lobby is verrrrrrrrry strong. But the AC21 measure also allowed employees to change jobs; not sure if that was entirely in their interests.
In any case, tying our fate to H1B is not a wise thing to do. The house will reject it one more time. They simply don't want the H1B increase. What we saw last year is an increase of only 20K for folks with advanced degrees in spite of the industry lobby working so hard. The industry lobby would have liked many more H1Bs. They don't care for the green cards or the plight of those trapped in the process. I have heard a top exec from a top tech firm say that after they finish their 6 years on H1B, they are welcome to go back! Actually, many prefer it that way. Alterego, you've pointed out correctly that the industry cares for NEW workers.
If anyone is seriously thinking that the industry lobby will (in the lame duck session maybe) sneak in an increase in visa numbers in a bill that asks for more H1B, he/she is in a state of delusion. Had they been that concerned about the issue of retaining employees, they would have asked for higher visa numbes when they lobbied succesfully for an increase in H1B itself during the Clinton years.
IV's is on the right track. It may take time to get them to understand the difference, but it is achievable in a year or two. What is also likely is a temporary increase in visa numbers; this was done some time back, and we should have no problems with that.

Most industries outside of some of these body shoppers do want to retain their employees. I know that for a fact, that is clearly the intent of the law as well. Hence most industry lobbysts also try for increase in visa numbers. Their priority is however the H1b as this is where the gate is.

I still didn't get one answer though. Maybe somebody from the California chapter can answer this. Is it true that in california most of the H1b extensions beyond 6 yrs for consulting companies are getting rejected, saying that you cannot sub-contract on H1. Does it mean that it has already started? Can anybody throw some light or prove the validity of this statement.
Sorry to stretch on this issue so much but even though I am consultant, I have an offer from my client to directly join them. Now, I will probably make more money as a consultant, but these days the way the lawmakers in this country are juggling with immigration issue, it seems it is lot safer to accept a perm position. Even though lot of my freinds disagree with this saying that this can never become law, as a lot of big US companies depend on short term high skilled labour to get their work done from time to time. Some say even if senate passes the house will not pass the bill etc etc....

Some projects may be moved off-site, as in big contracting companies doing actual work in their premises, some will go to India. some H1Bs may be lucky to be hired as "direct employees" by the clients, those who can will switch to EADs (which don't have such restrictions). For others, it'll be the end of the road.

You are correct. Upon corresponding with Ombudsman's office, their response was also the same. Although they added we can expect an approval by end of the week. Good hing we already have an Infopass appointment scheduled for Friday morning. Do you think we should "demand" and Interim EAD or an "approval email" be provided - something my wife can carry with her on Monday to the firm that is willing to hire her? Do you think they would be nice enough to issue the "approval" email?
Infopass depends on officer, some are nice... nice in the sense they do one step further to help us. Some are just reads through the lines and repeat what we know. I would call it lucky to get expedited or any means via infopass. Only option is ask them to call NSC and check on status. That might help or even email if required. Employers generally dont ask for approval email or treat it as an approval you need to wait till the card. if that would be so we wouldnt be in this problem in the first place.

What if you have H1B extended and valid for the next 3 years. If you travel today and return today using AP, your I-94 will be valid only till the date of AP, which means you have to ensure that you renew your AP before the AP expiration because that H1B status is no longer valid. I have always read that you may be able to work on H1B even if use AP - That may still be true, but you have to continue to renew AP without a delay / miss else you will be in Unlawful status. Am i correct?

I am in a helpless situation...My AP is still not approved, but I have only 4 days left for my travel.
I am trying to talk to "real person" at USCIS, but it would not give me any option to do so. The only option I did not pick is "report a problem with case". I tried all other options.
It looks like I will have to cancel my trip. Even if they approve today, I may still not make it as it have to come in the mail....I would like to give one last try by talking to Immigration Officer.
Those who called USCIS, can you please tell me how you contacted?

Here is a simple math say there are 1000 Green Cards and say 25 countries in the world then each country will get 40 GC every year. Now Yugoslavia splits into three and East Timor seperates from Indonesia so it becomes 29 countries so per country becomes approximately 34 GC and now earstwhile indonesia that was till now getting 40 GC will not get 34 + 34 = 68 GC because it is now two countries. The number triple's for Yugoslavia. SO where is diversity you are now just adding more people from same place.
